My wife is a Pharmacist, working for a major company. In the process of GC, 140 is approved and 485 is pending more than 180 days. She works in one state and I work in another state. Now, she wants to relocate to my location and work for the same employer. Company also agreed for the relocation.
Company has its own attorney to look into immigration matters. We have talked to the attorney and he said that she could relocate to any place in US as 140 is approved and 485 is pending more than 180 days. In this regard he would apply H1B transfer/new LCA for the new location. He also said that he does not apply AC21.
In this forum, I remember seeing messages stating that AC21 is required even for the same employer. Because the job in new location stipulated as a new job, hence AC21 is required.
What I feel is that the attorney is trying to avoid additional paper work for AC21. Will USCIS deny 485, if attorney does not apply AC21 for new location? We cannot force attorney, as we are not paying him. He goes by his mind.
How safe to relocate new location without AC21?
