Hi,
I have received the AP renewal but it will be valid from Aug 27th 08, the same day when my old AP expires. I will be travelling on old AP while going to India (Aug 15th) but while coming back (Sep 2nd) I will have to show the new AP which will be valid at that time. My question is -

Will this be acceptable to immigration officer since the new AP which I will be showing, was not valid when I was leaving to India? Can I show both APs to prove that I had an old AP which was valid while leaving and now new AP which will be valid while re-entering?

Thanks in advance.

Whom you will show your Old or New AP while leaving country ?

I never heard that we should show our AP while departing country. Please can you clarify your question ? (I know we should hand over I94 card)

OK. Fine. We may not need to show AP while leaving but while coming back, my new AP will be valid, which was not valid (but approved) when I was leaving. My question is " Can I come back on new AP which was not valid when I was leaving but was approved?"

Are you sure ? They mentioned valid from Aug 27, 08 ?

I checked mine it says " Date Issued was current date ". I dont know how you got August 27, 2008. Please check one more time your AP dates..

Yes I've noticed they have done this - including to both mine and my wife's new APs. When we received them, the "issue date" was about 2 months into the future, the day after the old one expired (my wife's AP processing took only 19 days from TSC). There is no clear USCIS directive to explain this because, after all, the rule is that your AP must be approved before you leave. We didn't enclose copies of our old APs with our applications, but still got this.

I didn't face your situation because I haven't taken a trip that overlaps between the expiration of one AP and the initiation of the other. You do have proof (in the form of a USCIS case status webpage that proves the date that the document was mailed to you or the document was approved), which you can print out and have with you. It's anyone's guess whether or not you will face problems, and even lawyers are not likely to give you any more than an educated guess. In my opinion, I don't think you will be denied reentry.

Your Aps are in the computer system and when they scan it at the POE, all data will show up including the issue date, actual send date ....etc. Just travel and let us know if they grant or deny your enterance. My guess is that EAD/APs which are currently free (with the new higher fee of I-485 only) put the USCIS in big stress and trying to decrease the work load. One time they said the EAD will be for 2 years, do not apply before 120 days. and now they issue the AP effective from the expiration date for those who applyed earlier. This will include all applicats with or without fee.
