Hi,

I changed my employer and got a new I-797 with I-94 valid
upto jan 2004. I have an old visa stamp from previous employer
valid upto jan 2004. my previous employer cancelled my h1b.
in this situation i have following questions.

1) Can I use the old unexpired visa from previous employer
and New I-797 from current employer
for travelling arbroad and reenter united states.

2) what documents required at POE.

I read the visa revalidation website http://travel.state.gov/revals.html it is mentioned as follows

"Please note that you do not require a new visa merely because you have changed employers and received a new I-797 petition from the Immigration and Naturalization Service (INS). If your current visa is still valid, you may reenter the US with that visa as long as you are in possession of a valid I-797, even though the visa contains the information from your former employer. "

http://www.usvisanews.com/memo689.html

"INS Discusses Validity of Certain Non-Immigrant Visas, which states:

"...current INS and State Department policy is that in the case of an H, L, O, or P nonimmigrant visa, the visa remains valid during its validity period regardless of a change in the beneficiary's employer. As long as the alien remains in the same nonimmigrant classification, the visa is considered to be valid until the date of its expiration. Accordingly, the memo states, an H, L, O, or P nonimmigrant alien who changes employers in the U.S. but remains in the same nonimmigrant classification, may use the previously issued visa to apply for admission to the U.S. if it is still valid."

if anybody had this situation pl. share your experience.

Thanks
