Urgent! Suggestions for Birth Certificate .

Hi All,

Me(primary) and my spouse got an RFE for the Birth certificate as it was issued late and they are asking for additional evidence or an affidavit. My parents are here on a visiting visa I can get the affidavits notorized here for me.

Can I also get affidavits from them for my wife as from Aunt and uncle.

You should get affidavit from her relatives about knowledge of her birth. They should be an adult when ur wife born and should familiar with birth event of ur wife. Your parents affidavit will not work, since they know ur wife after ur marriage legally.

My wife is related to me through my mother and she is know to my parents before marriage. My mothers last name and my wife last name before marriage are same.

Technically, it will work. However, if a half witted CIS officer interprets it as you trying to do a fraud, u could be in deep doo-doo. Why take the chance? Have someone from her home get the affidavits made and fedex to you.

I had the similar situation few months ago. We had an RFE for our BC when my Parents-in-law were here last year. I submitted the notarized affidavits signed by my Parents-in-law for my wife(non-availability certificate) and myself(BC). I was told by my lawyer that it is legally valid. Hope this helps.

I agree with you 100%. It is not worth taking chance when it is easy to get affidavits from home.
