Urgent! spouse 7th year extension based on my 140 approval?

Hi,

My wife's 6th year H1-B visa is expiring on November 1st,2009 and her employer is trying to apply for her PERM now. will she be able to apply for her 7th year extension once her Labor is approved or she has to wait till her Labor and I-140 is approved?or please let us know the other possibilities.

Also I have added her in my labor application and I-140 too and my I-140 is approved few months back.my I-485 is not yet applied.will she be able apply for her 7th year extension using my -140 approval?

or please let us know the other possibilities for her to apply for her 7th year extension.


Please Advise ASAP if possible.

To qualify for 7th year extension her labor must have been filed 365 days before end of 6th year (in this case by October 31st 2008). Alternatively her I-140 must be approved. In this case the only option seem to be that her I-140 must be approved before November 2009 to qualify for the 7th year extension.
No, she cannot qualify for the extension based on YOUR I-140 approval.
