Urgent: Some one wants to use my labor when I-485 pending

Hi,

I filed my I-485 in oct 2002 and I-140 approved 1 year back. I'm working on my IInd EAD. Recently the company I work for started layoff's and in mean while i got a new position in same town. So, I accepted the new job and joined last month. Just for info: I already passed 180 days and I checked with my lawer and he said no problem to join in the new company. I sent a letter to INS last month "Change of jobs" and informed I joined in this new job. Once I sent letter, I observed my LUD changed.

Now I came to know some one in old company trying to use my labor and filed an application. Unfortunately he has same skill set like me. I don't know how he can do?? The old company's lawyer left from that office and this new lawyer doing all this stuff.

Bottom line "Is it mess up my I-485 application (Green card process)?". I'm really scared what to do?? My lawyer is out of town. Guru's please help me. what to do??
 
You don't have any problem...Make sure your employer has to give the letter same as your approved labor certification. IF you already informed USCIS about your employment change and used AC21.

Just let your previous company know u already used AC21 for the approved labor, and no longer valid if you cancel (I - 140)or give (Labour)to different employee. He will not apply for the next person.

Thank you Bash. I informed INS about my change of jobs by sending a letter. That's what my lawyer instructed and he sent a format of the document. I used the same letter and signed it and posted to INS using certified mail. Do u think this process is "AC21" or some thing else I need to do??

The previous company bought by another company. The management changed. So, even though I inform them I don't think they will do any favor to me.
 
If your lawyer informed INS about your job change, no thing to worry. The person who is taking your labor is no-longer valid and you are already using.

Don't worry, check with your lawyer did he sent AC21, I am not sure how it looks like (Format). As for as I know your offer letter.

Keep cool and enjoy, until you are approval.

nenu7, I am not sure how they can do that? I always thought that when you file I-140 you have to submit original LC along with it and INS does not return any documents even if I-140 is revoked.

But, even if somehow they manage to get the original LC, you don't have to worry about it. The only time you need to be careful is if they revoke your I-140. INS seems to have some confusion on this issue. Even thought law entitles you eligibility if you crossed 180 days, but there have been cases where they have denied AOS, but some people have finally been approved after an appeal and case reopen.
