Urgent: RFE Please help

I have got a RFE, which requests evidence for my last entry to US from Canada.

In May 1998, I went to US Consulate in Canada to apply a new H-1 visa stamp, since my wife wanted to visit China and she did not want apply H-4 visa in US consulate in China. Her H-4 status is dependent on my H-1 status. When I left US from Detroit, I did not turn over my I-94 (This is advice of my lawyer). I got H-1 visa stamp from the US consulate, and entered US in Detroit from Canada. At that time, the US custom just looked at my passport and let me in; they did not issue me a new I-94. So, virtually, I don\'t have anything to prove that I entered US at a certain data legally. This kind of entry to US is very common at the boarder of US and Canada, and US and Mexico.

My attorney is going to write a letter to INS to explain the situation.

Does any of you guys/girls out there has encountered similar RFE, how did you respond, what was the result? Any help is deeply appreciated.

Border Crossing from Canada to US

Yes, I was rfe-ed for the same situation. went to Canada in Nov 98. Came back to the States 2 days later through Detroit US-Canada Bridge without a new I-94 Form or passport stamping.

My ND is May 8, 2001, LIN 01-170-xxxxx. Was rfe-ed on 3/12. On 3/21, my attorney sent them a notarized copy of my passport page showing an entry stamp from Canadian Immigration when they admitted me in Nov 98, and explained how I came back to the States without a new I-94 Form.

On 4/4, AVM acknowledged the receipt of our reply.

Still waiting for INS decision.

My attorney has sent a letter to explain the situation and they attached my credit card statement of that period as some kind of evidence.

Could you post the result when the INS made decision on your case?

I got the same

I got the same RFE on 04/12. I think my lawyer will handle it using the similar way.

Could you guys update me your approval decision in the near future? Thanks in advance.

Approval After RFE on I-94

FINALLY MY CASE WAS APPROVED ON 5/13 !!!!!!! FREEDOM !!!!!!!!!!!!!!!!!!!

I got an RFE for same issue.RFE was replied on March 28th.Still waiting.
