URGENT : RFE on EAD,AP

Hello guys,
My wife's EAD,AP have an RFE.Both says additional info is needed.I'm expecting the same in her 485 application as well.

The story is:

My wife was on F-1 at the time when we applied for AOS ,AP,EAD and H4
She got her H4 first ,however in the AOS ,AP,EAD applications she's still a student as these are applied after H4 is applied.

She didn't apply for OPT , infact she'd applied for EAD as 485 adjustee using marriage certificate.

I was suspecting that INS might have got confused with my wife's status now.

I'm yet to receive the RFE details.Please let me know what do you guys think.I shall keep you posted.
 
Mostlty the RFE would be for color copies of passport or color copies of DL or photo Id. Dont worry man, its just usual

Thanks a lot.I've a question.When the status changes from F1 to H4, is the SSN still valid or do I need to apply for TIN number which is basically assigned to a dependent by IRS.

I'm a little confused as my wife already have the SSN and should I really think of going to IRS and requesting for TIN number.

Does this have any impact of this on AOS ,please let me know.

NSC : August 2004 EAD/485/AP/140 Filers

Here're my details ;
I-140/I-485/EAD/AP
RD : 07/29/2004
ND : 08/03/2004
FP : 09/28/2004

EAD AD : 10/04/2004
AP AD : 10/05/2004
I-140 : No updates

Please let each other know the processing dates,we can atleast predict the dates.

I am also in the same boat. I got an RFE for both EAD & AP and my wife also got RFE for AP. I don't know what it is?

please keep on posting the details.
 
I'd received the RFE details from attorney.I reviewed it ,it says

Proof of relationship as spouse required (marriage certificate).
Receipts of 140,485 are required.

Did anybody ever experience such a rediculous RFE?I'm 100% sure that attorney has filed all documents and sent out as single package.

I'd received my EAD card and AP approval also !!!!!!

Best part is FP is done and 485 status says procesing resumed for me as well as my wife.

So does something like misplacing documents happen in INS?(Especially NSC?).

What could possibly go wrong? Or is the INS purposefully delaying the processing?

All that my attorney doing now is sending the same papers once again.

How rediculous the situation is?

May be my case is small.Still there're several hundreds of cases like this ranging differrent complexity levels.

May be why can't somebody file a lawsuit against NSC and stop this kind of nonsense for forever?

I guess you need to provide :

* Marriage Certificate
* If you live together, give your Appartment Lease document
* Bank Statement - Joint
* Marriage Picture
* Tax Return
* Benefits form - Like Medical Insurance ( Family ) etc
* If you guys exchanged Gift cards - Birthday card, etc

This will help them to know about your relationship.

Since INS has specifically asked for your marriage cert, just give that document.
Giving too much might confuse them !!

No need for all these papers. Marriage Certificate (plus notarized translation if document is not in English) is way enough. I agree with max2k1 - give them what you are asked to give. It is not a marriage based GC process.

What July140 is saying is almost correct. They may also would like to have a notarized copy of her birth certificate (word to word translation in english).
They asked color copies of passport for my wife during EAD/AP application few months ago.
 
Using EAD while on H4 status

Hello guys,

I know for sure that spouse can use EAD and work while maintaining the H4 status.

Say for any reason if she wants to go back to H4 status what's the process?
Do I need to inform INS with any kind of forms??

----- the day she uses EAD for work she will invalidate H4 status

----- if she has valid H4 visa stamp go out of US and enter showing H4 visa stamp and she will be admitted on H4 status and will get I-94 based on H4 ( if primary H1 holder is still on H1 status) if she does not have H4 visa stamp when she want to enter she need to get H4 visa stamp based on primary H1 holder documents if primary is on H1 status.

If I want to shift to using my EAD with same employer who has my H1 which is expiring (for whatever reason I do not want to extend it) is there any paperwork I need or employer needs to do.

You need to fill a new I-9 form with your employer - show your EAD as proof of employment -- that's it.
 
RE : URGENT : RFE on EAD,AP

Guys,
My attorney charging me 100 for RFE that he'd received that requires no brains to answer.

Infact the company had paid him entire fee and now he says it's the mistake of INS asking for already submitted information.So it's not the attorney's resposibility.

That's why he's charging the paralegal fees.I know that what attorney's saying is bullshit.

What can I do.It costs me more if I'd to respond through another attorney.
Can I compain to www.bbb.org about this.

Please let me know .I'm thinking about future consequences with this attorney.

If I were you I would spend the 100 buck. Although an attorney should ideally respond to RFE without asking for additional fees, but I have seen example of lawyers demanding much more than the $100 you are being asked to pay. Also I don't think complaining will have much effect other than to antagonize the lawyer against you. Sorry, but you may have to 'pay' with a pinch of salt.
