Urgent Question regarding Wife\'s status

Hi :
I am from India, on H1. My wife came to US in Dec 1999 on H4. When I filed for my I485 , I statyed on H1 and she got her EAD. She started working on her EAD.
In Nov/Dec 2000 , we went back to India for a visit. At the Port of Entry at JFK/NY the officer wrote H4 on my wife\'s I-94.

We have a finger print due on 15th of March.My laywer and Human Resource are advising my wife to go out of the country as it is th ONLY way to
correct the I-94.

Can anyone please advise.....

Yes, she had a AP, but the officer didnt see that. He wrote H4 and she came in US.

Please share if anybody had a simillar experience or knows what could be done.
Can I go to the local INS office and get the I94 corrected?

While I cannot provide you with any solution to the
problem all I can say is that it should have nothing to
do with the FP . They do not check your I 94 during the
FP process . Only valid ID such a drivers license and EAD
if you have one . And then later when the approval cones
thru then once again I don\'t think they will check the
entry category on I 94 . Maybe I am missing something here but I
do not foresee this as a problem.

I agree with ABCD 100%. I94 has nothing to do with FP. Once you got approval, then they ( INS) take whatever I-94 that is with you. I know a friend of mine who got recently stamped at New York, they did not even bother to look at anything other than some empty page in the passport to stamp, because of long line ( 2 hrs waiting). So don\'t hit panic button un necessarily.
