urgent question regarding EAD

Currently I am on 7th year H1 extesnion ( upto April 5 2005 ).
I have EAD which expires on April 18 2005. I have filed EAD renewal
(receipt date Feb 15 2005).
It seems currently VSC is taking more than 90 days to approve EAD. If my
EAD renewal doesnt come by April 18 2005, do I have to take leave of absence
from my job? Can it affect my I485.

Can I work with EAD renewal application pending?

Also what are the paperwork that my employer must complete when I switch over from H1 to EAD.

Technically EAD wait time is 90 days. It means there a month gap which you may not be eligible to work.

Now a days VCS is processing the EAD apps in less than a month (My recent experience with EAD) but you can not count on that becasue of 90 day rule.

Safest thing is to extend yout H1 to one more year. Probably you should take a legal advice.

Thanks. I have valid AP till Aug 2005. Can I travel to India with my EAD expired and valid AP?

It isn't a mandatory by USCIS but usually it is recommended by lawyers to have a valid EAD and EVL letter when you come back to US on AP - just that to be safe.

Gurus,

Do I need to take vacation only or is it necessary that I have to take a job discontinue while the EAD gets renewed.

I cant believe how stupid the laws are. For H1 they are allowing
to work while it gets renewed but now doing the same for EAD.
