Urgent Question!! Please help

Hello there

I have labor and I-140 approved and waiting to file for I485 but the priority date is not current 05/2005 (GOD knows how long that is going to take). I have to make some decission about my current job and need your suggestion.

I have 2 B.Sc in Computer Science Degrees, MCSE/MCSA in Windows 2003 and Windows NT; and whole bunch of training in SAN, MOM, Veritas Enterprise Backup and etc; currently doing Master's in IT (not done yet!! long way to go) - also working in IT since 1997.

What are my options if I want to switch to a different employer. Is my current I-140 going to work (can I transfer this???) because I do not want to wait another 5 years for this damn!! :mad: :mad: process -- which does not make any sense.

----------------------------- you cant transfer I-140 or LC. If I-140 is filed by A and you join B then you have to start GC process from first step. You CAN get early PD if you you file second I-140 and at the time of filing second I-140 inform your lawyer to recapture early PD by giving him evidence of your past I-140 approval.

PD is May, 2005 and I-140 approved in July, 2006. Also question for you if I move to different state within same company what is rules vs. if I want to take a job with different employer

--------------- if working for A on H1 at XYZ location and A sends you to ABC location for work then your employer need to get new LCA for you for new work location talk to your employer lawyer for more info.
vs. if I want to take a job with different employer
-------- join new employer after H1 transfer filing petition reach the USCIS or you get the H1 transfer filing reciept

So you are saying at this moment if I move to different location with same company they have to file for a new LCA and go through the same process (they cannot use the same PD or approved I-140?).

Also if I moved to different company all these are papers are not going to do anything? (I heard you could move your papers ... etc - I might be wrong) - have to start the whole process from the beginning?

--------------------------LCA is for H1 and for New Location. it has nothing to do with I-140 or PD. dont mix LC with LCA. for more info why you dont talk to your company lawyer
