I had an approved I 140 from my previous employer (company A) with a priority date of april 2002. I joined a new employer (company B) a few months back.
They're advertising for my labor certification and they say that if all goes well they should be able to file my labor in a few months. They also say that IF they do not find any applicants with resumes, things will get cleared in a few months. What happens if they do get matches for the job position? How does it affect my labor application?
Assuming that works out -
1) How long will it take for me get my labor approved under PERM
2) Given my PD is current, can i concurrently file I 140 and 485 together? Is it the employer or my choice to do so?
3) How long will it get the I 140 to get approved once again? 485?
Another question is transfer of PD. My old employer assured me that the PD will be transferred to the new company. I heard that if the I 140 is approved then the old employer can really do nothing to stop my transfer of PD. Is this true? What if they use my labor for another employee and use the PD tied with my labor for the other employee? How can I still transfer my PD in that case?
Im sure many of you would've faced these situations. Help and suggestions are invaluable.
