Urgent-pls reply-->CP opted-->I-140 approved-->company got merged and name changed.

I am sorry but i did not understand the part where you wanted me to ask my HR...what is it that i need to ask my HR? When I mentioned w-2 i was talking about 2001-2002 w-2 which all of us should have since we have filed those returns last year. 2003 w-2's i am guessing are in the mail and generally everyone receives between last week of jan - mid feb.
 
GUYS IT WOULD BE REALLY HELPFUL FOR ME IF YOU CAN POINT ME TO SOME WRITTEN DOCUMENT THAT SAYS THERE IS NO NEED TO REFILE I-140 IF TWO COMPANIES MERGE. MY LAWYER IS AFTER ME THAT UNLESS I SHOW SOMETHING SOLID SHE IS NOT GONA GO AHEAD.

you can change the lawyer

If your Lawyer is not agreeing with you and your case is at NVC you can just fill a form and change the lawyer..Or you can do it by yourself if the company agrees...
It will be difficult to find some thing in written either way. Even your lawyer will not be able to show you something in written that says that I140 needs to be refiled.

One of my colleague was in this situation when his I-140 was approved. The lawyer made him file second I-140, which luckily came through in 2 months.

If you are doing AOS you don't need to file another I-140 as you will ge AC-20 protection. As it is guaranteed to take more than 6 months for AOS.

I concur with someones recommendation that :
1. Either you change lawyers - uvwxyz
2. Or If you r on 485, then like thanickel recommended use AC-21 for portability

If it was true that one hasd to refile I-140 after company merger/ acquisitions/ splits then the entire green card I-140 process would be refiled by more than half the applicants whose companies have gone through it in the last 3-4 years!!
