Urgent-pls reply-->CP opted-->I-140 approved-->company got merged and name changed.

i have opted for CP for my green card.
My I-140 got approved and my packet 3 has also arrived but recently my company got merged with some other company and the company name also changed.
This happened after my I-140 got approved and before my packet 3 arrived.
My lawyer says that new I-140 has to be filled with the new company name.

Please advice.

I was in a similar situation where in the midst of my gc process, my company bought one of the big five to form a new entity. All I did was carried newspaper advt and letter from my corporate hr about the company merger and name change and that before and after the merger i am with the same company!

I would still consult another lawyer to get another opinion!

So were there any questions asked in the counsulate?Were they ok with the name change and merger of the companies.

Yes i completed my cp interview on 10/27/03 so about 6 weeks back in bbay. Yes the consualr officer noticed the company name change between my LC application, H-1B extension and on Employment notarized letter that I submitted at the time of the cp interview. I had carried public advts. plus my attorneys had given a letter stating such name change hence was not explicitly asked but i know the name change was noticed!

My company merger 4 times during my GC process but as long as you are in the same position nothing should matter in fact i also had a name change actually the company name was shortened but there was no issue

thanks kd...could you elaborate on what all affidavits and legal documents you got from your attorney.i will also try to get the same from mine.

I did not carry any affidavits. They were simple letters:

1. From attorneys: Stating the name change from xx to yy on xx/xx/2001 and name change again from yy to zz on xx/xx/2002.

2. From my company HR: Notarized Employment letter (required for CP interview) which stated the the company name change!

3. Print outs of name change published in papers/ magazines:
I carried this just as a back up evidence to 1 and 2 above.

Frankly speaking company name change (especially in this market where company's are being acquired and merged and re-split) should not be an issue if you carry above 3 things for the cp interview.

even i think that is does not makes sense to refile I-140 with the new company name but still i was concerned that they may raise some objection during the interview and then it will be a problem.
keep me posted if you have any more things to tell me.
 
My company got acquired

My company also got acquired after i-140 and before interview and i had the employment letter from the new company, so it was noted by the Immigration officer. I had a notarized successor in interest letter prepared by my lawyer and signed by head of HR that i had presented and was accepted by the officer. hope this helps.
 
which name will be used??

My case is also a similar scenario.

Got my I14o filed, but name changed between I140 filing and I140 approval. The case is now at the consulate for a possible Feb interview..

Assuming that I take the following documentation,

- Notarized Employment letter on new company letter head
- letter from HR about the name change
- press resport about the name change from website..

firstly, will I run into any problem at the consulate ??

secondly, what company will the visa be for ?? All the paper work has been under the old company name , and all I have as far as documentation abt the name change are the above 3...

getting pretty cofused over here...

When you say what company will the visa be for ?? i am thinking you are referring to the green card. If that is true then the green card is for you and there is no annotation of company name like it is for h-1b visa where the visa stamp includes the name of the company sponsoring

was ur tax id also changed after the merger.
was ur company taken over or your company took over some company.
please let me know.

My company took over one of the big five in mid 2001, then split to form 2 companies towards end of 2002 and since then have been seperated.

I will check my w-2 from last 3 years and let you know if employer tax id has changed. My impression is that it has not!
 
I was reading somewhere that if tax id changes then need to refile I-140 so thought of confirming that as in my case my Tax ID has changed.

I checked my w-2 for last 3 years and realized that in w-2 my employer name, employer identification number and employer state id are different for before 2001 vs from 2002. And I did not have to re-file i-140.

If that was the case then half of the folks would be re-filing some or the other sub process of GC since 1000's of companies have gone through acquisition/ mergers and splits in the last 3-4 years....

I am not sure about refiling i-140 due to tax id number change....all that i know is that my employer id changed but i did not have to re-file i-140!!!

I will try to collect more information on this one...if you find some more info then i would love to knnow. please post here!
 
My EID had changed too

My EID and employer name had changed too and I did not file a new I-140.

As far as I know for an employer , the EId is either their taxId or linked to their tax id so it would have changed too. I cannot say for sure yet as I still have not got my new w2. Kd1403 you may be able to ask your HR people, since you already have your W2.
