URGENT : Pls Help : Petition Made - Changes Required

Respected Sir/Madam,

My employer filed a petition on 9th Aug 2005 for conversion of my B1 Visa to H1 Visa. We received the WAC # and I guess the approval intimation will come only in October end or later. However, until then I will not be able to work and I have to stay here. Is it possible for me to go India now? In that case will we be required to change the petition from change of status to overseas filing?

I am a CPA frm California and currently I hold a 10 yr. Multiple Visitors Visa.

If the change is permissible and we change it, will it affect the answer to my petition?

Can they reject my petition in such a scenario?

And, will I get a visa stamp from Mumbai Consulate?

If my H1 is rejected either from USA or Mumbai, does that mean that my visitor visa is also void?

If your B visa I94 has validity until Oct 2005, better stay here until your h1 gets approved, if not extend the B visa stay..

Rejection of H1 at USA will not affect your B visa.

Rejection of H1 at India some time affect your B1, if the H1 or your documents are fradulant.

AS already mentioned in previous posts my H1 petition is made on 9th August 2005. So far I havent got an answer. I presently hold a B1/B2 Visa with a 10 year multiple entry. My questions:

1. I dont want to work in USA right now. Maybe next year or after that I might want to come back. I will be leaving for India before the end of 2005. Do I need to ask my employer to withdraw my H1 petition that is pending right now?

2. If we dont withdraw the petition and it gets approved what happens next? The next time if I want to come to USA for tourism purpose can I come on my B1/B2 visa? The records will show I was already given an H1 before so that would require me to come only on a H1 stamping from Mumbai. And I dont want this mess to happen in future.

3. If in future I get a job and want to come back to USA can I again apply for H1 visa (even though it was approved this year and I didnt work in USA)?

Please help me ASAP and please answer the above 3 questions as I need to ask my employer to withdraw the petition accordingly. Please Great Guru.
