Here is my situation.

Current H1B VISA expire date - SEP-2004
6 Year H1B completion date - 31-MAR-2005
Labor filed on OCT-2002 and applied I-140

Now I am in a situation where I have to file one extension (for 6yrs) in SEP-2004 and again one for 7th year ext in MAR-2005. Based on prcessing time I don't think I would get 6th yr ext before MAR-2005(end date of 6th yr), so won't be able to file 7th yr at that time.

Is there any rule/law by which I can file 7th yr extension while applying for my normal H1B extension in SEP-2004.

I would really appreciate for any suggestion/help/advice/thoughts

Alren,

I really appreciate your response and thats what I had in my mind too. So suppose I apply for 09/04 through Premium processing and get the approval in 15 days. After that when couldI apply for 7th yr extension? is there any time limit b4 which you should apply for 7th yr extension and do I need to stam 09/04 approval on my passport b4 I apply 7th yr extension?

thanks a lot pal.

I'm not sure about the time, but I think it would be 3-6 mos. The lawyer will have a better clue.

You do not need a stamp on the passport. The stamp on the passport is only for travelling.

if your employer is ready file using premium processing at his expense then you are ok. if they expect you to pay then you may file it under regular processing.

In case you did not get the h1 approval under regular processing prior to 6th year then you can still file your 7th year extension using the receipt notice of the latest h1 filing.

visa stamp is required only to enter. once inside your h1 approval and i94 prevails.

also you are allowed to work upto 240 days after filing h1 extension (this is not applicable for fresh h1 or h1 change of status like h4 to h1)
