I am going to complete my H1 6 years status with in couple of days Can I able to stay in USA as

1. My Husband has new H1 , can I become H4 and stay as dependent in USA?


2. My new born baby is citizen, Can I become guardian to her and stay in USA ?

Please let me know the possibilities of staying in USA in my case.

No problems!

AFAIK, you can apply for H-4 and stay in the country. One of my friends did it and he has his GC approved later.

>> No, you cannot stay on H4 if your H1 limit is over.

>>No, there is no provision in any law which allows you to stay in this country as a guardian of a citizen. It has to be under some visa - visitor, visa, F1, H1 of AOS or GC.

Please let me know the possibilities of staying in USA in my case.
