I am going to complete my H1 6 years status with in couple of days Can I able to stay in USA as

1. My Husband has new H1 , can I become H4 and stay as dependent in USA?


2. My new born baby is citizen, Can I become guardian to her and stay in USA ?

Please let me know the possibilities of staying in USA in my case.

1. No you won't be able to change your status to H4 since all H status are the same and are subject to the 6 year limit, doesn't matter if it is H1 or H4.

2. I'm not sure about this one.

How can you become a guardian to your own child? Having a US citizen child gives you no special ability to stay in the US, until the child turns 21 and sponsors you.

Don't you have a pending LC or something to give you a 7th year H?

No, the six year limit is applied to all H visas.
2. My new born baby is citizen, Can I become guardian to her and stay in USA ?

No. Having a US citizen child gives you no priveleges to stay in USA.

Please let me know the possibilities of staying in USA in my case.
