I am going to complete my H1 6 years status with in couple of days Can I able to stay in USA as

1. My Husband has new H1 , can I become H4 and stay as dependent in USA?


2. My new born baby is citizen, Can I become guardian to her and stay in USA ?

Please let me know the possibilities of staying in USA in my case.

Neither of the options you mentioned are possible.

Time spent in both H1 and H4 status counts towards the 6 year limit. There is no legal provision that allows alienn parents of US citizens to stay in the US.

You seem to have run out of most other usual options. I suggest you should consult a competent lawyer who can advise you ased on your specific case.

If you have applied for your GC and it's been quite a while since the priority date on the LC, you can get a year's extension on your H1 until the GC is approved or denied.

Is applying for O-1 VISA an option for you? I know of medical professionals and postdocs at Universities that regularly avail of this VISA category after H-1B expiry which technically can be indefinitely renewed - you have to show progress every three years of achievements etc. A good lawyer might be able to assist with this.
