I have filed my mothers green card (I-130 and I-485). The documents were received by the chicago office today 23rd July. My mother is currently in the US on a B-2 Visa. Her I-94 has the stamp till 28th July.

Can she continue to stay here after 28th July in the US if we do not receive the receipt till 28th July.

This is very urgent as i need to cancel her airlines ticket.

I will really appreciate anybody who can answer this for me.

Thanks

You are an US Citizen right?

Her status is no longer ruled by the I-94 stamp. Her status is now "pending" until a decision is made in her adjustment of status petition.

Which means, YES she can stay (and she SHOULD stay) until the petition is approved and she receives her green card. :)

Yes my sister is a US citizen and she has actually filed for my mother. What if the receipt date is after her I-94 date, does it mean she is out of status for that date?

I guess then, technically she was out of status for a few days, but you usually get a receipt within a month of filing so it is not a big deal.

I have mailed the I-130 and I-485 application on 21st july by fedex overnight to chicago and was received by USCIS on 23rd July 10 am. I have yet not received the receipt from USCIS, so getting a little anxious.

I am wondering what is the time it takes to receive the receipt and do we see the cheque encashed from the bank account before the receipt is received?

Also my mothers who is on visitor visa(B-2) has her I-94 expiration date on 28th july, is there a need for me to file the visitor visa extension or can she stay as her AOS case is considered pending?

Please help!!
