Urgent ... Please Help

Hi All,

We received RFE for BC on 08/19/2004. We are about to send the neccessary documnetation for the RFE. But the problem is... We are travelling to India on 09/24/2004. What will happen

1. If we receive the approval when we are in India???.

2. If we receive the approval around Sep 22 and we don't have time to go for the stamping....

Is it safe to travel to India under these circumstances??. What will be the best option for us???? Please help.....

You may be able to get in with AP (though in theory it is invalidated once you are approved). I would delay my travel plans if I were you. Mind you, I would'nt even MAKE travelplans if approval time was rolling around.
 
485 approved while overseas

I asked the same question to my attorney before and he said if your 485 is approved while out of the country you are still NOT a green card holder yet until you get your stamping at the local office. So you still can return to US with AP.

As long as you have your AP , you are fine.

Search the forum for "deferred inspection" -- you'll get a lot of threads relating to this.

CIS has its way of doing things -- one should not change their lives drastically to accomodate weird processing patterns of CIS .... I mean who really knows when they want to approve your case ??
Go on with your plans (just return before the AP expires ;) ).
 
Thank you guys for your inputs!

My attorney says that she can e-mail me over a scan copy of the approval notice, if approved while I'm in India.

What do you guys think, would it be advisible to show the copy of the approval notice at POE OR just show them the copy of advance parole? I know that AP becomes obselete, when I485 is approved. Please comment.

P.S Recently my 3 rd AP was approved too, which I guess might have triggered the RFE, so I guess I should be o.k for next 1 year.
