URGENT: Please help......

Hello,

I have only 2 months left for my 6 years H1 period. Not filed for labor yet. Can I get my 7th year extension, even though not filed for labor? I am looking for a pre-approved labor. If any one has references about the labors, please let me know.

Any help would be greatly appreciated.

Thank you the info and I need little bit clarification.

If I get a pre-approved labor, and if I filed I-140 and 485 simultaneously before my h1 expires, then, can I get my 7th year extension?

If not, filing of 485 will keep me in legal status even after h1 expires or I have to get INS receipt in order to stay legally? I know, I have to wait until EAD get approved in order to work.

Please help!

If you get pre approved labor, you can file I-140/485 concurrently & based on pending I-485 You can get h1 extension.

Also if you cannot file h1 extension but file I-140/485 on time (before your H1 expiry) you will be in "Adjustment of Status".. You may not be able to work for couple of months (H1 expiry till you get your EAD)... Receipt of I-485 is your proof of lagal status in US in that case & you will need AP to travel outside US.

Need one more clarification....

Does this work the same for h1 transfer also? In other words, can compnay B (who has pre-approved labor and is going to file for I-140 and 485) file for my 7th year h1 extension? or only through compnay A? Right now my h1 is with company A.

Please help!
