Hi Everyone.
My wife is on L1 visa and me/my daughter have got L2 dependent visa. My parents (sponsorship is my wife + Self) had the interview in tamil at Chennai Consulate on 11th Feb 2009 at 8.30 am. We had availed the VFS lounge facility. All documents were prepared as per the requirements mentioned here.
During the interview the visa officer was handed over the HDFC Receipts, Passports, DS forms which were put in a folder and given by the verification counter. Other documents, covering letter were with my parents.
VO asked most questions to my mom through the interpretor(Lady)
VO:Who is there in US? Mom: Daughter-in-law
What company ur daughter-in-law works for? XYZ company
How many kids u have? only one Son
Wat is your son, Where is he? Doctor at chennai
What is he specialized and in what field? xyz field
Son's marriage date 00-00-0000
Do you have grandchildren? yes one granddaughter
Where is your granddaughter? at xyz place with my son's in-laws
How long u intend to go? 6 months ( the same as mentioned in DS 156)
Finally the visa officer wanted my wife's documents andgoing through her passport copy asked -
"Has ur daughter-in-law been to US before" for which parents had said Yes.
(My wife was in US earlier in 2007 for 45 days on a project)
Then VO asked -
Does your Son and Grand daughter have visa?, for which my dad said Yes.
At once the visa officer said that my parents have lied to her about this. My father said -"Ma'am only when asked we thought we should tell this information", ( honestly none of us knew that it had to be disclosed voluntarily whether asked for or not)
Then the VO sternly said -"No it has to be disclosed voluntarily"
and then rejected their visa on 214(b) grounds.
When my dad asked her about reapplying she said that yes they can apply again.
My query is that the VO never asked for any financial documents/about social ties nor was an oppurtunity given to them to say about it or show the relevant documents. She just took the HDFC Receipt, DS forms, Passport and later my wifes documents- I 134, passport copy only. No other documents were asked. She had refused the visa as my parents told her about mine and my daughter's dependent visa only when asked for it and had not disclosed about it beforehand.
My wife's visa is getting over on 19th jan 2010 and her project is likely to be over by this Sep 2009. We genuinely want to just go for a trip there and return. My daughter and myself are yet to go to the US as i thought if my parents also get a visa i can take them along. My Mom wants to be with us for about 6 months to enjoy the country though my dad wants to be there for just a month and return back due to the financial and social ties here in home country (lands, house, pension and elderly mother).
My dad (64yrs) is retired/pensioner and mother (61yrs) a housewife. They have agricultural lands and house valuated about 6 Million INR and have sufficient bank balance with his retirement benefits. My dad's mother and mom's mother ( My paternal & Maternal Grandmas) are partially dependent on us. Dad has an Elder brother and Mom has two younger brothers.
We plan to reapply again this March 2009. How shud my parents be prepared this time or should i only send my mother this time? Shud we include the detailed covering letter which clearly states my wife's Visa Status ( L1 expiring on Jan 2010 and Project getting over likely by Sep 2009), my parent's financial and social ties in india and documents proving their financial ties in India along with the HDFC receipt, Passport and DS forms when asked by the VO, so that the VO gets a chance to read it.
Can we apply this early or shud we wait? So even when we reapply there is no question about Situation Change from the previous occassion,as for in my parents case it was never an issue with financial/social ties ( it was never asked ). VO just said she is rejecting their visa as mine and my daughters visa status were not disclosed voluntarily but disclosed only upon when VO asked about it. Me an My daughter are in India and not in the US.
We all want to go there only for tourism purposes only. Shud we mention in DS 156 about me and my daughter having L2 visa even though we have not yet travelled to the US?
