I am working in India with a company. I had applied for H1. Now that the approval (I-797) has come i am trying to fill DS-156 and DS-157 to get appointment at the consulate for interview. I have doubts in following:

1. DS-156 Question # 20. "Name and Address of Present Employer or School" Should i give name and address of my current employer in India or the employer in USA who has filed H1 for me. Please note that upto now i have not worked for that company in USA who has filed H1 for me. Is that company still considered as my employer. If asked to produce proof of my current employment i can show salary slip of the company i am currently working for in India.

In case i mention my current employer as the US company which filed H1 for me, will i have to tell the consular, if he asks, that i have already resigned from the Indian company for which i am working.

Also please note that there is another question (question #32) which is similar to quetsion # 20. Question # 32 says "Do you intend to work in the US? (If yes, give the name and complete address of U.S. employer). For this question we definitely need to mention the name and address of the company which filed H1 for me. But what about question #20. I see a lot of conflicting answers on the forums for question # 20.

Please share your experience. I dont have much time. I have to quickly fill the forms.

2. DS-157 Question # 12 "Not including currently employer, List your last two employers" (This question is related to DS-156 Question #20) In my case i am still working with the Indian company. In case i consider as currently employer as the US employer who has filed H1 for me (if that is the answer for Question #20 of DS-156), then i need list my current employer in India. But in case i give my current employer as the employer in India (in response to Question #20 of DS-156), then i will not list the current employer in DS-157.

Please help. I dont have much time .....

Thanks a lot

Please note that this is a fresh H1 case.

DS-157 why should i leave it blank?

Hi Raj

Thanks a lot for prompt reply.

I am somewhat not convinced with the reply you posted for DS-157.

This is because, for DS-156 we are mentioning that my present employer and address is the company which filed H1 for me. As a result, the company for which i am working in India should be listed as my last employer in DS-157. However, i haven't yet resigned from company in India. Will resign only if i get H1 Visa stamped. I am really confused whether to give the name of the company i am working for in India in response to question #12 of DS-157 or not.

Let me put it this way, i cannot be employee of 2 companies at the same time. If i mention in DS-156 that my present employer is the company in USA which filed H1 for me, in that case i should no longer be an employee of the company i am working for in India. Therefore in DS-157 i should put the name of the company i am working for right now...... and i will be working for even when i appear for the interview at the consulate.

Can you please explain the reasoning behind your answer for Question#12 of DS-157?

What if the consular asks me in the interview that why i have not mentioned the company in India in response to question#12 of DS-157? Will i have to explain it to him that i have n't yet resigned from this company?

Please help me out with this.

Thanks a lot again .... somebody please answer.... i need to fill up the forms quickly.
