My I-140 got approved and I-485 is peding from March 2007. Now I am eligible to apply 3 year H1B extesion (beyond six years). Once I get new 3 year H1B extension and assume that my I-485 is denied for some reason. My question:

Is my 3 year H1B extesion is still valid? Can I live in US for next 3 years. If YES/NO please mention the reason.

Yes, you can live in US till the validity of your new I-94, which will be attached with your new I-797 approval notice. I got my three year ext. last month after completing my 6 years in US.

So, don't you worry about your status.

H1 and I-485 are both different petitions. If problem with I-485 and have H1 extension till XYZ date then H1 is valid (IF YOU DON’T USE EAD)

I am asking this question before talking to my employer requesting another H1B extension. My employer will ask why we need to file another H1B extension. Now I can answer that with this extension I get 3 years of visa with no dependency on I-485 status I will try to convince my manager H1B extension is beneficail than EAD which was filed but not approved yet.

Note: My employment with this company will be over in approximately 3 years (Company two months back started SAP project)
