Gurus,

I am currently working as a Software engineer and have got a job offer with a different title (Risk manager) with a different company. my 140 was approved in oct and 485 is pending almost for 6 months now.

Can I change my job with AC21 rule in the light of my job title being different with the new job? . I do understand that one needs to move to a similar job in order to be considered for the AC21 rule

what are the options avbl to me ...please advise

I'm no expert on AC-21 (not even close) but it sounds to me like this would be risky unless the actual duties are more similar than the difference in titles implies...

With your ND you also run the "risk" of your I-485 being approved at any time, i.e. before you can move to the new job (if that happens it's best to stay with the current employer for 3-6 months).

Of course, there are some who feel that even though the rules are pretty well defined, the risk of these actually being applied to you are minimal. In a recent thread, we seemed to agree that although the risk is theoretically there, we couldn't come up with a single case that we knew of where, say, someone was denied citizenship because of leaving a company < 3 months after getting their GC...
