URGENT-new H1

Iam on H4....I applying for new H1visa this year. I sent all my papers to my lawyer. But The I-94 is valid upto feb 2005. Also in the "Notice of Action" H4 document. Today we(me-h4 & my husband-H1) got the extension papers with i-94's approved, in which the valid dates are till feb 2006.
Now will there be any problems in my H1 application with the previous sent doc.'s or Do I need to send the new ones(with '06 validity dates).

As per the best of my knowledge "It's nothing to do with your H4".
Don't worry and don't be panic, this will have no effect on your's H1 process. Be brave....

Because they mite think that my validity date has expired and I may be in illegal status which is not correct. Is it better to send or will they get our record of the extended status from their database?? How does it work??
 
Sorry for the delay....
Did you provide your attorney a copy of the receipt of your Visa's extension (Your husband's company/attorney might have received the confirmation document from the INS that includes the date of your application received and the application Fee ...etc). If not then it is allways good idea to send a copy of your recent documents. Since you have to submit your I-94 at the Port of Entry, keep original copy with you.

Did your attorney file your case. Please keep in mind that you filed your H1 when you are in active status. There is no illegal issue here because You are not in out-of-status at any instatnce. You are in legal status....
 
If you already applied for H-1 then you need to wait for the USCIS to process your case. They will issue RFE if they need any additional documents. If they raise any out of status issues then you need to submit your new H-4 approval notice. No need to worry since you are not out of status.

One more related question-- I got the H4 -797 form stating the validity to feb '06 but I did not get the i-94 card with the 797 form. But my husband's doc's are reached. Can I send the only copy of the 797-form. ??Or should I wait for my 797 form with 1-94 card to come??
