URGENT! Need to notify INS for H1 stamping in India?

Hi,
I am working on H1B and am about to go to India to get my H1 visa stamped. This is my second renewal (3rd H1).
My company lawyer (not an immigration lawyer) told me that I CAN NOT get visa stamped in India unless i notify INS about that in advance.

He told me that i will have to
File Form 824 (takes 130$ and upto 90 days).
Only after that i can show up in mumbai to get visa stamped.
I had never heard of this before.
With just a week left for my departure from US , I would really like feedback on this ASAP.

To make things more difficult,
My previous stamp has expired so I can not come back on that.

Please Help!!

Please let me know if there indeed is any such procedure.
Or I can just go to mumbai consulate with appropriate docs and get it done (either in person or drop box).

824 is for permament residency

Hi,

If I am not wrong form 824 is for permanent residency. Are you going for H1 stamping to GC stamping ????

I too thought that 824 will come in picture for GC (CP).
I really feel that my lawyer is confusing between GC stamping and H1 stamping.
 
Your lawyer is very wrong

You dont need to notify INS to get visa stamped in India. All you need are your approval (I-797) notice and other supporting docs. The required docs are on the consulate web site. Plus since you have a visa on your stamp already you can use drop-box facility.
 
I824 is the form required for getting the duplicate of any document INS sent. For GC it is used to notify the consulate about I140 approval.
As suggested by other posters, H1 renewal stamp does not require I824 or consular notification- The first H1 stamp does require a consular notification.
 
I am going to Toronto for my H1B Multiple Entry Stamping........my case is F1-OPT-H1. Do i need to file the same form I824??
