Hi

I kindly request someone to answer these questions..and i thank u all in advance.

1. I applied my I140 in Feb 2003.

2. I applied my I485, EAD, AP in Oct 2003 without informing my employer. But i did submit a general employment letter from my employer when i applied for I485.

3. Now my I140 was approved on jan 2004. And I am 180 days past to use my AC21.

Before using AC21 i have couple of questions.

1. Given the above scenario, can my current employer do anything to stall my GC process.

2. I want to continue with the same lawyer.. But i have not informed them yet about using AC21. If the lawyer refuses to support it, what are my options? currently i paid all the legal expenses for my GC.

3. What do i need to get in terms of documents before using AC21 from my current employer?

4. What do i need to do and get from my current lawyer if they refuse to support my AC21?

5. My future employer is willing to give same title but description can contain more technologies besides what is mentioned in labor. Will this cause any issue?

6. My salary will be 5k more than what is mentioned in the labor. Will that cause any issue?

7. My new employer will fall in new juridisiction.. ie nebraska instead of texas.. will this cause any issue?

7. Assuming that my current lawyer is going to support my GC. then if there is any rfe.. Who will get it. Is it employer or lawyer.

8. Assuming that my current lawyer is not going to support my GC and i go for new lawyer. What do i need to do in this case.

Before using AC21 i have couple of questions.

1. Given the above scenario, can my current employer do anything to stall my GC process.
------If I-140 approved AND I-485 pending more than 180 days and you find new job in same/similar skills then you are eligible for AC21. past employer can not revoke the I-140 even if he sends letter USCIS is NOT going to revoke the I-140 and I-485 belongs to YOU.
2. I want to continue with the same lawyer.. But i have not informed them yet about using AC21.
------No need to inform them that you are going to change employer and dont talk to the company lawyer. lawyer is paid by company so he works in intrest of company. you can hire YOUR lawyer
If the lawyer refuses to support it, what are my options?

currently i paid all the legal expenses for my GC.
-------- My suggetion hire YOUR lawyer
3. What do i need to get in terms of documents before using AC21 from my current employer?
----- find a new employer who is ready to give you future permanent job offer letter when you need with same job title and skills as on approved LC
4. What do i need to do and get from my current lawyer if they refuse to support my AC21?
----- dont tell lawyer or employer you are going to use AC21, just ask the copy of approved LC ( particularly Form ETA 750A that has your skills on it) copy of I-140 approval or I-140 filing reciept and Copy of I-485 filing reciept

5. My future employer is willing to give same title but description can contain more technologies besides what is mentioned in labor. Will this cause any issue?
------not problem but it will be better if he writes on letter same skills, job title as on approved LC ( skills are more important)
6. My salary will be 5k more than what is mentioned in the labor. Will that cause any issue?
---No problem
7. My new employer will fall in new juridisiction.. ie nebraska instead of texas.. will this cause any issue?
-----No problem, just update your new address on your pending I-485 or any pending petitions

if you change location do the below:
1 file form AR11 for address change
2 update NCSC on 18003755283, your new address, provide them your ,WAC,EAC or LIN # of I-485 and reciept # of any pending petitions with service center, provide the receipt#, your name, DOB, A#( A# is on I-485 filing reciept)
3 write letter to service center for address change on your I-485 or any pending petition with them provide your past and NEW address, attach I-485 receipt copy, write your name, DOB, A# on cover letter. Send the letter to your service center with certified return receipt and out side the envelope write in big bold letters ATTENTION: ADDRESS CHANGE
*** do the all 1,2,3
7. Assuming that my current lawyer is going to support my GC. then if there is any rfe.. Who will get it. Is it employer or lawyer.
------ your I-140 is approved so no RFE for I-140. if any RFE for I-485 it will go to lawyer who filed I-485. if you hire your lawyer then fill up the new G28 Form and he will send it to USCIS and he will get if any RFE that way your new lawyer will represent you and USCIS will have record of new lawyer
8. Assuming that my current lawyer is not going to support my GC and i go for new lawyer. What do i need to do in this case.
----- replied above.
