Urgent need help..I-94 issue

smbps: I am in same situation. Could you pl. tell me how you corrected it

Did the CBP officials gave the same old white I-94 with new expiration date on it? or what?
I am in the same situation and eligible to file I-485. And I don't want to miss this opportunity. Pl. provide the info on this.

two I-94. which one to use in I-485 application

I have the following important question related to I-94 and I need the answer from any of you ASAP.

I got the I-94 during the Port of entry (when I enetered the country last time on September 25, 2006) that was valid until December 25, 2006. But, later in October 2006, I received my H1B extension paper I-797 which was approved in September 12, 2006 which has the new I-94 attached to approval notice with the validity from December 15, 2006 to December 15, 2009. This new I-94 has the new number than the one on the I-94 that was given in POE(port of entry) i.e. white I-94.

Now, my question is
1. Which I-94 should I mention in I-485 application? White I-94 or the I-94 with H1-B approval notice?
2. Should I correct the white I-94 that is in passport and What is the procedure for this?

I am confused in this regard. Pl. respond me ASAP. I am awaiting for the reply ASAP

hkmarch05,
Usually when you send for the extension, the attorney will ask you the white I-94 card.Once you receive extension from the USCIS along with the I-797A, you will see the original white I-94 card details which will exactly match what you have.

As per you, you mentioned that the white I-94 card no & the I-797A(you will see the exact number on the bottom of right corner) are not same.May be you forgot to give the I-94 details before extending.

My case is same as you. What i did is, i went to nearest CBP office & got it corrected. The CBP officer corrected the dates on the I-94 card what i had it.
When i went to CBP office, they escorted me..Initially i was worried & they looked at the database, they corrected it.

Hope this helps.

Hi

Thank you smbps.

I went to local CBP office in LA and they corrected the same I-94 (white I-94) that was issued during last POE. The validity of the I-94 is same as on I-797 validity date.

Thank God...God is great.

Urgent help required

Hi Smbps,
i am having the exact problem of urs... The I-94 no in the new H1 extension is same as my old I-94 before leaving the country in FEb 2006 instead of the New I-94 (though expired on sep 30)that i was issued at the POE while reentering in march 2006...
The CBP site says, if CIS made a error in the form, go to them for correction.. Looks like u got ur I94 corrected by CBP office itself... what did u exactly tell them? Am in deep confusion since im scared what if CBP office say thay they cant correct? i need to apply for GC too..
Do let me know as soon as possible..
thank you
Skytam

Hi skytam,
You need to call them & tell your situation.Don't mention that USCIS made a mistake.Let them decide who made it.Usually they will correct it.

smbaps

Hi smbaps,
I have similar problem here too. Did CBP changed the dates on your white I-94? or they changed the number on your I-94 to match your 797A?
thanks in advance,
-kopus

As GeeCee Mentioned ,bottom line is chek following

1)check if you have an I94 form (doenst matter what number you have )with H1 approval notice ?
2) If yes and it as date 2010 then you are absolutly ok ,

Just different story but good to know :
I had very bad or good aexperience at canada boarder ,I had to drop my parents this side of us and did not have valid I94 form or visa stamped on my passport and don't know some how I cress us side and came back and had to go through Immmigarion officer . Based on my social security he checked my status and let me come back . So in your case I belive you have I94 valid until 2010 and only problem is it has same no then it is ok if they use same no then it is not your fault . It is jut my opinion not legal advice .
