Hi,

I am in a pickle. My OPT expires on jan 15th, 2007. I did a MS in Engineering. I have found a job, but the H1 B visa cap has been reached. Please advice me regarding the same.....

What kind of advice are you looking for? Do you have a question?

You have a 60 day grace period after your OPT expires. After that, you will be out of status. If you stay longer than the grace period, you may have problems in the future if you apply for any sort of nonimmigrant or immigrant visa.

I want to stay in the US. What are my options... Also, is there a bill to increase the no. of H1 B visas for 2007???

You're in a tough situation, sorry to hear that. You can try finding a job with a nonprofit organization or higher education (universities) that can sponsor an H1B Visa. They are exempt from the H1B cap.

You could go back to school and get another Master's? Deadlines are usually around november and you could maybe still use your existing GRE score. Not a great solution, but it's one that's possible. With a Master's , you can't go back to a community college, so you have less options as far as what you can study.

There may be other options since Immigration laws and circumstances are many, but I don't know. A lawyer would probably be able to tell you if you have other options.
 
H1 status problem

hi, i am i exact situation as you have. my OPT will expire next may 07 . i got job before quota was over but unfortunately i didnt file the H1. now my company will file my H1 next april 07 and transfer me to india branch for 5 to 6 months. so wht you will suggest me ? can i go to india and work with the company there or go for school and stay here till OCT ? is it possible to come back from india after doing job there? wht are the chances to get H1 stamed there? please reply me about this issue. i really appreciate your help.
