Urgent! Labor transfer

Hi,

I was recently offered an unused Labor by X employer. One of my skill set matches with the persons skill on whose name the labor has been filed, but my education background ( He is Mechanical Engineer and myself Electronics engineer with masters in computers) and also the number of years experience doesnt match with his. MIne is less. What Shud I do? Is it OK to take that labor? Please advice.

As I understand, one would qualify for labor substitution based on whether one's profile matches the job profile for which the labor cert was filed - irrespective of the original applicant's qualifications or experience. Get a copy of the labor cert, look at the job description, and see if you match the requirements 100%. It might be difficult for you to match it yourself. I recommend using an attorney for the purpose.

Thanks nshalady for ur reply. I had looked at the description , if there are 10 skills described in the labor, my resume matches with 8 skills the other two can be matched coz they some how related to the other 8 skills. Skills are mtaching, my only concern is abt the educational background and the number of years experience. He does not have masters, he has Bachelors in engg with 5 yrs of experience and I have Masters with 2 yrs of experience. If I can manage to show experience of one yr in between my bachelors and masters ( exp from India) and an experience of my internship I did during my Masters in NY, would that be good enough? How can I manage this situation? Please throw some inputs. I appreciate it.

Here "He" does not matter. As Nshalady has said, what is written on the LC is what matters. What education and experience is required on the LC?, forget about the original applicant.
