Hi

As mentioned 2 H1B ..i want to make it clear..

1) i hold H1B with a research lab( which wont be counted in H1 quota) - this is my first H1B

2) i got a offer from an external company( profit organisation) for this i have to get H1 counted in quote.

my question is ..,

i)) can i hold the current H1 and apply new H1B ( in parallel) through the company with-out transferring one i got now

ii)) OR i have to transfer the existing one. if i do so can i start work immediatly or i have to wait until october

iii)) OR is possible for some to hold 2 H1B at the same time

Can someone help me on this

thanks

You can have two or more H1-B employers at the same time and each one has to file an I-129 on your behalf. You will have to be counted for the next employer if that employer is not a cap exempt employer. You are subject to the H1-B time limit so keep track of how much time you are actually in H1-B status overall. For the cap subject employer, you may not start until the date shown on the approval notice/I-797/I-94. The new cap filings begin April 1, 2011, for a strat date of Oct. 1 or after.

You can transfer from cap exempt to cap exempt anytime.
