Urgent in using Advance Parole.

Hi All,

Status: I485.

We(I and my wife) have used AP for entering US on India trip first time in June. So our H1 and H4 revoked automatically. Now, we both are on EAD but wife not started working yet. Again my wife(dependant) went to India second time on Aug 12th and coming back on Nov 13th(Total days 93). My lawyer saying that she can't say more than 3 months on AP. I am little worrying because of it is crossing more than 90 days. Is that ok or she should be in USA within 90 days. Please advice me and share your experience.

Who told you that using AP automatically revoke your H1 and H4 visas? Your lawyer?

I read that using AP won't affect your H1/H4 visa in quite a few discussion threads. Please clarify. Thanks.
 
Thank you very much for your reply. Your right, may not revoke auto, but i am sure my employer revoked H1 and H4 after 180 days of I485. So we can't use anymore our H1 and H4. So my wife has to come on AP only.

Please can you share your experience in using the AP?
I have a AP and EAD (Reciept date 21st Jan 2002) and in India currently. I plan to go to US on Nov. 29th. My H1 is valid till 15th Dec. So I plan to use my AP. Is there any letter I need to take to show at POE. Let me know. Appreciate it.

dar: AP is valid until the expiry date. Your lawyer is talking gas.
risktaker: Just have I485 receipt copy handy just in case(not a required document). You will be subjected to secondary inspection (inspected by supervisor). Dont be alarmed. Have photocopies of AP page with photo to give to airlines.

Last time i and spouse came together on AP. We just gave them AP forms. They took us into further investigation room and asked us to sit. They took passports and AP forms with them and checked something. After 15 min came back with stamping asked us to go. It was just checking whether AP was real or not.

I suggest you to come on H1, because of you have an valid H1.

The reason I asked about AP is due to my H1 expires on Dec.15 2002 (both Visa and H1-status). Then I will be on EAD automatically right?
So, if I have to give the length of stay info on POE am I limited to 15 days if I use H1??
