I'm ready to apply for a green card next month, in may-2008.
so, there are 2 options
1) Ask my lawyer to fill out the i485 form for me,and I will be charged $400 for his service.that is a pinch, after i add up everything including the i485 fees $1010 and form i693 fee $100=$$1510/person:eek:, it's a LOT!!
2) filled out forms myself=$400 saving.

everyone (Asylee) in this forum has experiment and know how to fill form i485 out, plz give me some advice, and help me with following question, Thanks!!!!:)

In Part 3 (Processing information) of form i485, question 10 , it asked,
Are you under a final order of civil penalty for violating section 274C of the immigration act for use of fraudulent documents, or have you, by fraud or willful misrepresentation of a material fact, ever sought to procure, or procured, a visa, other documentation, entry into the U.S. or any other immigration benefit? Y OR N
anyone know what is this question try to asked, I'm one of the asylee in this forum, how should I marked this (50% chance right and wrong) question, Yes or NO.

IN part 2
it asked, what status did you last enter, can i answer this question with parolee, is this a common answer among asylee.

plz, give some suggestion on whether i should take the saving or hire a lawyer .

Thanks all.

I don't see any reasons why you should hire a lawyer for this. Stay assured, the knowledgeable group members will help you on this.

For part II you must report the status you last entered under. I do not see how this is a confusing question. What was your status then? Why did you enter as parolee?

The question in Part III is probably the most difficult question on the form and nobody can answer this without knowing your full immigration history.

One common situation that often comes up is did you use a false passport or visa to enter the United States? Did you assume someone else's name? Did you tell the embassy that you intended to live here only temporarily while you planned to seek asylum once you arrived?

Again I cannot comment further because I do not know your history. If your history is complicated you might want to seek the advice of a lawyer.

Hi thanksful, first allow me to thanks you for your comment at my 2 parts questions!!
I realized my case is little bit complicated too, and there are only one chance to filled out i485 form. therefor i have decided to spend $400 to buy a sense of security from my lawyer. yes, it's kind of stupid, but i do not want to risk my "single opportunity".

for my own history, like most of asylee, i first entering this coutry by either using a fake passport or no document at all ( which i don't remember, it's almost a decade ago),then "arrested" and put into "jail" by immigration officer at a u.s. airport, i had apply asylum inside USA. then three weeks after i was paroleed out of "jail" with the help of my citizen cousin, then the immigration officer give me a i-94 card stamped as "paroleed" ( that is why i answer the part 2 question as paroleed, and Stated at part 2 i was INSPECTED by immigration office. IS THAT RIGHT???)

let me asked this way for quetion in part 3, when a asylee entering this country by a fake passport, then he/she must marke this question withYEs, when a asylee marked YES , does it neccessary mean that he/she is not eligible to apply for a green cards anymore.

anyone(Asylee) who has similar experience, plz make a comment or share your experience here.

This is a great forum, i LOVE this place, once again thanks all for HELP!!!

THANKS!

When you answer yes to the question in part 3 they will ask you to fill out a special form to apply for a waiver (the form is called I-602). While the DHS cannot and do not guarantee approval in advance (the law says that they have to make a case by case decision) they are very generous with asylum cases. So this will not present too serious an obstacle for you.

You made the right call in using an attorney. She will be able to help you submit the correct forms.
