Hello,

I have I-797C with company A but my company was acquired by company B. After acquisition no amendment or petition was filed b/c company B is a successor in interest and takes all liabilities.

I need to go for visa stamping now, would i need to file an H1-b amendment to get a new I-797C with company B name or can i do that on the basis of company A's I-797C and take acquisition documents.

Please anybody having gone through the similar situation or experts please respond, would really appreciate any help.

Thanks,

Do u mean I-797A, coz I-797C is H1B Petition Receipt whereas I-797A is Approval Notice?

Regarding ur question, I guess if you carry acquisition documents and a letter from company B should be enough for Visa stamping.

Recently I moved to a company which was acquired by another corporation and filed my papers with the acquiring corporation. I have valid H1B visa stamp from old company.

Discuss with your lawyer if this is your first H1B visa stamping.

Yeah I meant I have I-797A the approval notice with company A name but the lawyer of company B is insisting to file an amendment so that I have a new I-797A with company B name when I go for stamping.

Can you please elaborate what you mean by filed you papers with the acquiring company and did you get your visa stamped before or after the acquisition?

I guess it's different if your visa is already stamped and the company gets acquired than my situation where I don't have it stamped yet.
