I filed my I485 in April 2000 and till date I never got FP. I spoke to IIO regarding my FP in April 2001 and he told it has been not scheduled yet. I received RFE in June 2001 for Marriage Certificate, W2\'s, Employment letter and recent pay stub which I submitted in July 2001. After 5 weeks AVM (Automate Voice Message) says "A written decision has been mailed on August 7th.
I am still waiting for that mail....... Any Suggestion

Call IIO and try to find out. I read in some post that INS thought they had sent FP notice but either lawyer did not receive or misplaced it. Later INS tried to deny the case on the basis that applicant did not attend FP date.

I do not know the out come of the case but it is very starnge that with April 00 ND you still did not get FP notice. Check with your lawyer.
 
Looks like an intent to deny

"A written decision has been...." mean an intent to deny notice has been generated. Probably because of no FP. Talk with your lawyer.

ND-10/00 no FP yet

ND-10/00 I also did not get any FP yet. Called IIO 25days back and he told me that they will be sending the FP within 30 days. But till now me or my attny did not get anything. Planning to call again after 30 days.

This means an intent to deny notice has been generated for your case. Immediately contact your attorney and prepare for your defense. Don\'t worry too much. Most of the time, such cases are resolved in favor for the benificiery.

Thanks for replying ..... I will check with my lawyer. I have been working with my company since last four years and never had on bench. I believe due to FP this thing happend. And also I spoke to IIO in April 2001 regarding my FP but he replied it has not been scheduled. Anyway let me wait for this letter from INS and I will be keep posting on the board.

Uday, I would advice you to contact INS earlier than 30 days and try to get the FP matter resolved. Keep a record of when you called INS and whom you talked to about this. This would provide proof that you had contacted INS regarding not receiving the FP. Otherwise they might send you an Intent to deny notice.

That could very well be the case. If an FP notice is sent out and the applicant does not respond within the prescribed time, it warrants an intent to deny notice. Once the applicant files an afidavit about not having received the notice, the processing is restarted. So, do not worry at all but start preparing your case.

Tomorrow is the last day to wait for the mail because AVM says a mail has been sent out on 7th Aug\'01 and if the mail is not received within 14 days call INS. Now, if the FP is the reason than do you think this matter can be resolved in 2 to 3 months because I filed my I485 in April 2000 which is more than 17 months. And also when RFE was generated they didn\'t ask for FP.I will ask my attorney to speak to INS. I don\'t want to involve in this FP matter. What is yor suggestion? Please give me your opinion. You know my situation. Waiting for your response ....

Soni, FP may not necessarily be the reason. I was just guessing that VSC issued an FP notice and there was no response from your side and hence the intent to deny notice. It could very well be some other reason.

Regardless, whatever the reason is, you (through your attorney) have to defend your position. If your attorney is not following up with INS, there is no harm in you being proactive and calling them up to find what the reason is. However, when it comes to taking action, you will have to involve your attorney.
