My friend\'s H1 expired in Dec.\'01, applied for extension, waiting for approval. He wants to go to India immidiately. He is thinking that he\'ll go and his lawyer will send the H1 ext. approval to India and he\'ll get it stamped in India. IS THERE GOING TO BE ANY PROBLEM WITH THIS? PLEASE HELP.

Precautions...

First the H1 extension should have been set for transmittal to your friend\'s home country consulate. Other wise his H1 extension might be considered abandoned if he goes out before extension approval.

Ask your friend to get this move approved by the lawyer, since the lawyer is the only person who will come to your friend\'s rescue.

Is your friend planning to stay outside US until the approval comes?
