MY friend was arrested last year for sitting too long in restaurant .Case was dismissed in pre trial with him taking some counselling help from court appointed doctor .He was on 2 year probation. At the same time before 2 years he was again arrested for domestic violence but case was decided with deferred judgement and 6 months DV classes. Will this have an effect on his green card application. he is in 1st stage .what be can be done so his green card is not denied.Any inputs?

In all likelihood he was not arrested for sitting too long, but rather for making a ruckus after he was asked to leave.

He was not creating a ruckus but only sitting for quite a long time. The waitress called the cops and the charge was only sittting for too long in a restaurant . Nothing apart from that was on the complaint.Shud he be concerned with this.any inputs.
Thanks fro the reply.

I sat in a Starbucks in DC a while ago, a couple of tables over were two homeless guys with all their possessions. Both of them had a starbucks cup in front of them (which they had picked out of the trash can). After an hour or so, the store manager asked them to either purchase something, or to leave. One of them knew the drill and obliged, the other made a big noise about it. As a result he was escorted out by the cops (I bet he tells his buddies that he got arrested for sitting in a restaurant too long as well).

The domestic violence conviction (yes, this is probably considered a conviction under immigration law) could render him deportable. I would need to look at the court records to be more precise so he should speak to an immigration lawyer who is familiar with the immigration consequences of crimes.

He wa not charged with too severe domestic charge he was arrested becoz he slapped his wife and she called police .then the judge did tell him that he cud be deported but gave a deferred finding judgement even before the case went to trial stating he had to take DV classes for 24 weeks and the wife during that time not be contacted becoz of Temporary Protection order being in effect.Till he completes those classes the passport wud not be given to him by court.
Although he did ask forgiveness from his wife and seems all is ok now he is worried he might be denied 485 as his dates are current and he is waiting for labor clearance.Any inputs.
