Hello,

I came to USA on B1/B2 (valid for 10 years) in April 2005. My I-94 is valid until Oct 2005.

In August 2005 I found job and they filed for H1. H1 approval came some days back with I-94 of 3 year validity. So this is a change of status case.

I wont be taking the job now and will be going to India before my B1/B2 I-94 expires.

Can I come back to USA next year in Jan 2006 on the same visitor visa I have?

Is it so that once H1 is approved by visitor visa is invalid?

If I come in Jan 2006 what problems can I face at the imigration counter on the airport in USA?
 
your COS happens the day the H1 I-94 starts, so what was the start date on the new I-94 you are on H1 since that day, and should join the company acordingly or else depart.

Noe the visa stam and visa status are two different things. You have the stamp in passport but status can change, as it did ion your case.

Just getting H1 approved does not invalidate the stamp, that can be used to reenter on B1/2.
The only reentry problem I oversee is if you do not join the company and remain beyond 60 days in USA from the start ot H1 there might be a question about illegal stay.
