Urgent Help Required

My last I-94 got expired in Sep 30th 2003.
I have my new Visa Papers with me, but since I did not leave the country
nor did I send it by post for stamping/revalidation, I do not have my latest
VISA stamped on my passport.
My question is, will this create any problems while sending my papers for
I-140 once my Labour gets cleared.

Depends.

Specify your current visa type. Was 'new' a visa extension or really new? What was type of old one. Do you have I-94 currently? What is the date on it?
 
My Visa Type is H1-B.
'New' was actually Visa Extension(Valid till 12/1/2004).
Regarding my I-94, well the one on my passport was valid till Sep30th 2003.
I did not leave the country after that.

Check bottom of your latest H1B approval notice. It should have I-94. Can you see that?

Are you married? If yes and if you wife is at home - ask her to see those papers - you are getting online help - thanks to VSC and wait for GC.
 
OK enough of bullshit.

Here is what you will see - you will find I-94 there. It will have same number as the one that you have. Now do you feel something ringing in the head? Relax - your I-94 is OK for you. And now call your wife second time - ask her if she has her I-94 ready(I am sure you filed for her extension too.). Ask her if her I-94 number match too. They do? Good then. You are all set - file 140/485 and eat drink be merry. :D

Nothing. I was kidding.

Just a final point - not with 140/485 - but with your H1 revalidation - if you do not get it done within a year of whatever is the date on your stamped visa - you will have to go back to your home country to get it stamped.

Actually I have to convince my attorney abt the same.
She has the opinion that I should have the VISA stamped on my passport.

Ask her if she thinks you are illegal/out of status? If not then tell her to go ahead with filing. Ask her what problems she anticipates?
