Hello I wanted to extend my parents visa . Need couple clarifications

1. IF there extension gets rejected is tehre 10 year mutiple entry visa automatically rejected ... How do I know that since there is nothing on thepassport that proves this ....

2. The affidavit of support should be signed by whom ME or MY husband ... my concern is if I will sign USCIS will think I am working and my parents r baby sitting ... well I do have kids but frankly they go to DAY CARE ... so please suggest what should I do

3. Can somebody email me examples of sample letter ... We think since they have one year valid ticket ... it makes sense to stay sicne it is not easy to come back on & off ... frankly every expensive and so they can spend time with me and my kids and of course do sightseeing ....

PLEASE HELP

Rule 222(g) begins to apply if the extension is denied and the person had stayed past the original I-94 date. The next visit is upto the officer at the POE whether to let them in or not. Some have come back, some were given warnings and given restricted stay, some have had their visas cancelled and sent back. It depends upon the officer on how strictly he applies the rule 222(g). In reality there is a risk in applying for an extension..

USCIS DOES NOT care about affidavit of support. You should apply for an extension only if you have a real convincing reasons, (eg family emergency, medical problems etc). Your reason of having a 1-year ticket and would like to spend time sight seeing etc are NOT VALID reasons. 6 months is plenty of time to spend with family and for sight seeing. A visitor is a person who comes and leaves, NOT start living in the U.S. A visitor needs to spend more time in the home country than in the U.S. If a visitor spends 6 months in the U.S, he/she spend atleast 1 year before coming to the U.S again. That is way one demonstrates ties to home country.

Regarding your sample letter, it is just a letter mentioning the reasons for applying an extension. If you are convinced that you don't have reasons or your reasons are feeble / frivolous, then there is no point wasting money applying for an extension and risking their 10 year visas.

The justification for an extension needs to be water tight. It must be something that couldn't have been taken care of in the initial 6 months stay. A busted hernia for example. More sightseeing, spending more times with kids and grand kids, is risky. At the end of the day it is your call.
