Urgent Help Required : I-751

Hi,

Today we received a letter saying our I-751 application is denied for failure to appear for biometrics capture. [Section 8 CFR 103.2(b)(13) and 216(c)(2)(A)].

Application Receipt Date : 02/23/2009 Vermont Service Center
We received 1 year extension letter on 02/27/2009.

But we have not received any biometric appointment letter till today!

We spoke to National Customer Service Center at 1.800.375.5283 on
04/28/2009 and 06/12/2009 to verify about the biometric notice.
They said we should usually receive in few weeks else call back in 45 days.

Any one had this situation? What to do in this case? Do we need an attorney to solve this?

To get a missing FP letter:
Call 800.375.5283, speak to 1st level customer service and open a service request saying that you have never received FP notice. They should provide you with a SR number.
Then USCIS has 30 days to appoint your SR to somebody, after the appointment they have 45 days to reply. Usually you will receive a reply much sooner.
Then ask 1st level represetnantive to tranfer you to 2nd level IO. They will pull up your case by your A# or notice #, verify that your residence address and mailing address is correct.

As for denial - the only thing that comes to my mind is to write to USCIS ombudsman and your senator with request to reopen the petition review due to lost mail.
