Urgent Help Please Labor Substution - salary difference

Hi,
My company had filed for Labor Substution along with I-140 one year before my H1-B Six Year completes. The Pre Approved Labor salary is $2000 US more than my salary. Company will be filing for 7-year extension in 2/3 months.
What will be consequence of salary difference in getting 7-year extension and future problems I may face in I-140 Approval and I-485 Filing.
Non Concurrent Labr Substution with I-140 only.
 
well the H1 salary and H1 LCA should match,

the salar in labor for GC is the future salary, so it should not matter as long as there is enough proof of ability to pay, in ur case the diff in pay should be enough

Hi All,

My company has a pre-approved labor that they can use for me. The only problem is the salary difference between what I am getting right now and what is mentioned on the approved labor. As this salary is what I should be making once I get my GC, the lawyer is asking my manager to just provide a letter saying that they will give this salary once I get my Green Card. But my company is not willing to commit to anything at this point.

Question: Can I still use this Approved labor? Thanks!
 
well when the company ... filed for the labor specifying the salary they in effect committed to that salary. Now the only thing that reamins is their ability to pay, different from wilingness to pay.

At this moment such a letter is not as necessary as the other financial documents that prove the companies solvency and financial health.
 
Why not consurrent filing ?

Just was curious - why did you not file for I-140 and 485 together ? why are u filing I-140 only ... has ur employer/attorney suggested that ?

Hi gurus there

I am new to this form. I am also victim of H1B 6 years limit. I want to go for labor substitution. will you please clarify me following doubts:


1.LC which I am going to use require only Bachelors and 2 years of experience. I have Bachelors (3 years from india) and masters (2 years from india) in computerscience and have 3 years experience. will it be any problem using this LC?

2. In LC under experience, previous IT guy mentioned 10 years of experience. where as I have only three years of experience. In LC under job offer require (14 th column) only 2 years of experience.will it cause any problems in my I140/I485 stages?

3.which is my priority date? is Lc (sustituted) filed date or I140 filed?

4. Can it be possible to change employers after 180 days passed and I 140 approved (luckily) in labor substitution cases?
