Urgent Help on RFE for I-485

Hi,

I got RFE for I-485 for my wife as proof of status. Her H4 was expired on Aug. 17, 2003 Applied for extention/changed for H4 with receipt date of Aug. 14, 2003. through new Employer. We did not received original approval so ordered duplicate. On dup. notice she got approved her H4 valid from Mar 2004 to Feb 2005. REF is what is status during Aug. 17, 2003 to Mar 2004.?

Does she count as out of status? We have recipe date for appl. of extention of H4 before 1st H4 expired.
H4 expired on Aug 17, 2003
NEW H4 filed with notice date of Aug 14, 2003 (but approved from Mar. 2004 to Feb. 2005)
By the way she got EAD by NOV. 2004 and all renewed on time.

Interesting situation. I am sure that this might be a clerical error on their part. If you have the receipt of the H4 extension, you should be clear.
They should have awarded the extension from the date of previous expiry.

I wonder why you did not sort out this discrepancy earlier with them.

I would suggest that you consult a good lawyer who can summarize and send these support documents as your rfe response.
I believe you have a good case.

Subsequent EADs are of no concern in this matter. They are trying to determine the legality of your complete stay in us.

When did you file I-485 for your wife....or what is RD for your wife's I-485....

Your H4 ext receipt is fine to show legal status.... It is authorized by AG....
 
we filed I-485 on 14 oct. 2004. Also we stamped visa on passport on oct 6th, 2004 for new extention at DC, USA.

I am also same boat as my wife, but nothing RFE or LUD on my case. I am the principle one.
