My sister sumbitted 140 and 485 concurrently in TSC center some time 2002. In march, her 140 was approved and she applied for AP.

The last week, she finally received a notice from BCIS about her AP application. but they said they couldn't find out her 140 and 485 application.

What to do?

Help, please!

File a law suite

File a law suite with the following logic:

1. TSC officially admits that the files are lost.

2. It has a history of delay and mishandling of information (you may need to research to prove the point on mishandling, delay is as clear as broad daylight-people are waiting for more than 2 years....

3. Since the I-140 and I-485 are officially lost, you can't get it adjudicated.

4. Hence the law should intervene and adjudicate this immediately.

5. Also appeal to the judge to issue a similar ruling for cases that are similar to you (i.e., cases, where TSC has admitted to losing or mishandling of files, should be adjudicated immediately...)

I would do this if I were you. If you buckle down... you will be exploited... fight for your rights...

Sincerely,
smisra

(p.s. I am not a lawyer, I am AOS applicant like your sister...The above points are my opinion only and not legal advice... I am frustrated with the delay in processing

This is a silly question, but she did enclose a copy of her I-140/485 receipts with the AP application, right?

hard to understand the lovely INS:)

Her EAD has been approved though.

I never understand what they are doing actually?
