Urgent Help Needed

Hi,

I am totally desperate right now. Of course its the weekend and I cannot get a hold of my lawyer. I'm a Canadian Citzen married to a US Citizen. My petition to adjust status has been filed and I thought everything was going great. Well, my husband and I are not getting along and we have thought about getting a divorce and I would go back to Canada.

How do I do that? Can I petition him from Canada? I will need child support and spousal support as I left and sold everything in Canada for him. Can anyone provide me with any advice????
 
Just leave for Canada. Not attending the AOS interview would automatically result in its denial. You could write a letter to USCIS (before you leave) informing them of your intention to withdraw your AOS.
Can't help you with alimony and child support. Those are not immigration matters.

If you do decide to divorce, you should withdraw your petition. If I were you I would try to establish child support before you would leave the country. Spousal support is not likely since probaly the marriage wasn't very long?
Maybe you can work out your differences. Going through this process is very stressful. It affects a lot of marriages. Maybe if you stay in the marriage then when the immigration process is over, then you will have a better chance at developing your marriage. I wish you the best.
