Urgent Help needed with 7th Year extension

Hi,

H-1 Valid until September 25th 2004
Labor Applied : October 9th 2003
Only out of US Vacation Time: Oct-18th 2003- Nov 17th 2003

Questions:
Is it mandatory to wait till October 10th to apply for 7th year extension?In which case i would definitely be out of status for few days.

Should we apply for Vacation capture first
(to get valid stay from Sep 25th to October 09th)?

Please..help...These date are making me nervous ..

----- you will not be on H1 after your I-94 gets expired
Should we apply for Vacation capture first
(to get valid stay from Sep 25th to October 09th)?
----- you can try and it should be filed by good lawyer
