------NO. For H1 transfer you need to be on Valid status with Valid I-94 and in US with latest 2-3 Pay stubs.

New employer can file fresh H1 for you and you will not be subject to Cap and inform Employer that H1 was approved in past for you and give him the copy of any evidence.
