Urgent Help in Finger Print issue

Hi all,
        I applied for my AOS(I-485) in February 1st week. I know my EAD and AP (Work permit and Advance Parole)will be due hopefully sometime after 2-3 months. That is by May 2002. I have to travel abroad for whole summer to take care of my mother. She will be having operation and I have to take care of her for the whole summer.
Now the Question is that usually the "Finger Print" appointment comes 4-5 months after filing AOS. In my case we can expect it to be sometime either in May-June. I will be back in Mid-August. Can anyone PLEASE help me in providing information. How long is the "Finger Print Appointment" valid? someone said its valid for 90 days. So even if it comes in May 2002, I can come back and get them done by August 2002. Right? I don\'t wanna go for Reschedule. Please Help! Thanks a lot
 
Make sure you know what you are doing

I am assuming that you are not going to be travelling till you rcv your AP by end of May. If you leave earlier, then you could have someone send you the AP to your address abroad. ***Please confirm that is indeed doable. ****

The ONLY reference to 90 days is as follows:
PLEASE DISREGARD THIS NOTICE IF:
1. You have been fingerprinted within the last 90 days
2. Your application has already been approved
3. You were under 14 or over 79 when the application was filed

Here is a quote from my FP notice.
"PLEASE APPEAR AT THE BELOW APPLICATION SUPPORT CENTER AT THE DATE AND TIME SPECIFIED. If you are unable to do so, complete the bottom of this notice and return the entire original to the address below. RESCHEDULING YOUR APPOINTMENT WILL DELAY YOUR APPLICATION. IF YOU FAIL TO APPEAR AS SCHEDULED BELOW OR FAIL TO REQUEST RESCHEDULING, YOUR APPLICATION WILL BE CONSIDERED ABANDONED."

There is a section called "REQUEST FOR RESCHEDULING"

"Please reschedule my appointment for the next available: () Wednesday afternoon () Saturday afternoon

INS cannot guarantee the day preferred, but will do so to the extent possible.
Upon receipt of your request, you will be provided a new appointment notice. Please mail your request to ************

If you have questions regarding this notice, please call 1800 375 5283
"

You can see that there is no provision for your signature when you reschedule. So...worst case you should have someone at your address here who can mark the FP notice and return it to INS upon your instructions.

Also...the FP notices depends on your address. People from SJ are quite far behind as compared to people from Oakland or SFO center\'s.

Hope this helps...definitely consult your lawyer before you do anything.

Thanks a lot man! It really helps in this regard. I am sure and as u said ...u r right. I will ofcourse travel ONCE and ONLY i\'ve my "Advance Parole" in my hand. So that\'s fine. I will get it either by normal time period (30 days) till May or I know even by showing emergency document I can get it "from local office straight away."

Regarding the "FP" i got ur point. Yes there will be someone to send the reschedule notice on my behalf to INS. But my real question was this:

When we recieve the "Finger Print" appointment date from INS, till when is that valid for? I mean till when can we show up there for FP to be done? Like is it 90 days duration?

I think for FP, you have to either appear on the day of the appointment or have to reschedule it to some other date, otherwise as per their notice your app is considered abondoned.
 
file I-485, not received approved notice for my J-1 waiver

I am filing I-485. From phone, my J-1 waiver was approved in June,2000, I didn\'t receive the final letter of approvement for my J-1 waiver from INS (CSC), because I moved to new place. I have tried to correct new address by letter and by phone. But phone is always busy. My questions:
1. Could somebody suggest better way to contact INS office about
    correct the address.
2. If I file I-485, what will happen.

As far as I know ....

you have 2 choices
(1) appear for FP at the appointed time as per notice
(2) prior to appointment date, request rescheduling.
(3) appear for FP earlier that appointed time ( after rcving FP notice )

For (2) please consult lawyer as to how late you can do this i.e can you ask for rescheduling the day before FP? I don\'t think so.

GET THE 90 days out of your head !!!! There is no such thing. It is very clear that you CANNOT show up for FP after the appointed time.

Think clearly and don\'t screw up at this last stage.

Hi, mahewaal, I just received my FP notice from INS (NSC) on March 4th. It gives me a particular date (04/**/02) and particular time (2:00PM) for getting FP done. But it also says:" IF YOU CAN NOT APPARE AT THE PARTICULAR TIME, YOU CAN GO TO THE SAME OFFICE AT ANY FOLLOWING WEDNSDAYS ON THE SAME TIME, BUT MUST BEFORE JUNE 27TH. IF LATER THAN JUNE 27TH, YOUR CASE IS CONSIDERING ABANDONED".

That is my case, which is quite different from Madman\'s. By the way, my location is Columbus, OH. It seems different location has its own way as per FP. It\'s just my guess. Hope it will help.

You can do your FP at any Application Support Center,if they can Accomodate you

Once you get your FP Notice, you do not need to wait for the scheduled date and time(if you have a valid reason/proof). but, you can go to nearest ASC and tell them that you will be travelling abroad,need to do the FP before you go. I am sure, they will do it, right on the same day(99%). so, you can finish off your FP before you fly, i Guess. but, it is not good to re-schedule your appointment, since no one knows the time delay it would cause in your AOS process, if you re-schedule. there is no 90days business in FP. you have to do at the time give or re-schedule to a future date, for which INS will again send you another FP Notice.

again, no one knows, after how long will you get your re-scheduled FP Notice. so it is better to complete your FP, even before the Schedule date, if you are in an emergency.

at some location they are scheduling FP within 1-2 months after RD so it is also possible that you might receive your FP notice before you leave.

         first of all I would like to thank you all for such great helpful replies. But my question is that "WHEN WILL I GET MY FP NOTICE??" Coz due to the emergency I will be travelling in May on my Advance Parole. But the question is that before travelling will I get my FP notice?? I applied for AOS (485) on 14 Feb 2002. So what do you all say by end of April or Middle of May will I get the FP notice? How has it been working with others? any clues?

When you get your FP notice depends on how lagging is your service center. Which service center do you belong to.? I know that for NSC, they give you a date and time and then again few weeks to appear on some secific day of the week.
